This policy explains what personal data Niyana Yachts collects through this website, why, who receives it and the choices you have. Our KVKK information notice gives the information Turkish law requires, and our cookie policy lists the cookies and browser storage the website uses.
Who we are
Niyana Yachts is a yacht brokerage based in Istanbul. The company behind it is responsible for your personal data. Its registered identity and contact details are stated once in the detailed KVKK information notice. You may write to info@niyanayachts.com about personal data.
What we collect, and why
When you write to us
You can write to us with the enquiry form on our pages, by e-mail, by telephone or on WhatsApp. When you send the enquiry form, we receive:
- your name, and your e-mail address or telephone number;
- your message and the details the form asks for on that page, such as the yachts you are asking about, charter dates and the number of guests, or details of a yacht you would like to sell;
- the address of the page you wrote from, the date and time, and the country your connection comes from;
- how you reached our website: the site that linked to our page, if any, and the campaign reference or advert click code in its address, if you arrived through one of our adverts or a partner’s link.
If you accepted advertising cookies, your browser keeps the first page of your visit and how you reached it until you close the tab, and they come with your enquiry, so that we know which advert or link brought it.
We use these details to answer you, to prepare what you ask for, such as a viewing, a proposal or a valuation, and to keep a record of our conversation. Your enquiry goes to the person it is addressed to and, where needed, to the colleagues who share the work; it tells each of them who else received it and who answers.
The form sends your enquiry through our website’s server, which runs on Cloudflare and checks it against spam, to our company account on Google Workspace, where it is kept with our records and sent by e-mail to the people who answer. Cloudflare Turnstile helps the server tell people from automated traffic. If your enquiry cannot be sent that way, the form offers to send the same message as an ordinary e-mail from your own e-mail program.
If you write to us on WhatsApp, WhatsApp handles the conversation under its own terms, and the person you write to may note it in our client records.
You do not have to give us any personal data, but without a way to reach you we cannot answer.
Legal grounds: the steps you ask us to take before a possible contract to buy, sell, build or charter a yacht; our legitimate interest in answering other questions and in keeping business records; and, where the law requires us to keep records, that legal obligation.
The newsletter
If you sign up for news from Niyana Yachts (new yachts, price reductions and news), we collect your e-mail address, your first and last names, and when and on which page you agreed. Our team reviews each sign-up before anyone is added to our mailing list. We send the newsletter with Mailchimp, which tells us whether a newsletter was opened and which of its links were clicked. You can unsubscribe at any time with the link in every newsletter, or by writing to us.
Legal ground: your consent.
The Shortlist and your preferences
The Shortlist, your currency and length unit, light or dark mode and similar choices are kept in your own browser’s storage. They are not sent to us. If you send an enquiry from the Shortlist, the yachts on it come with your message. Our cookie policy lists each item.
Analytics and advertising, only if you accept
Nothing for analytics or advertising loads until you accept it in the cookie choice. If you accept, we load:
- Google Analytics, to understand how the website is used: the pages viewed, the type of device and browser, the approximate area your connection comes from, and actions such as viewing or saving a yacht, searching the list of yachts, starting or sending an enquiry, or tapping a telephone, WhatsApp or e-mail link, with the reference of the yacht concerned.
- The Meta Pixel, to measure whether our adverts on Facebook and Instagram lead to visits and enquiries; it receives the pages viewed and the same kind of actions, with the reference of the yacht concerned.
These services set cookies and receive information about your visit from your browser, including your IP address. Google Signals is switched off, and Google Analytics keeps its detailed data for no longer than 14 months. We build no advertising audiences from these tools. You can change or withdraw your choice at any time with the cookie button at the lower left of the screen or with Cookie settings at the foot of every page.
Legal ground: your consent.
Keeping the website safe and working
Cloudflare, which hosts our website, processes technical information such as your IP address, your browser type and the pages requested, to deliver the pages and to protect the website and its forms from attacks, abuse and spam.
Legal ground: our legitimate interest in a safe, working website.
We host our fonts ourselves, and the map on our contact page is a still image, so neither passes your visit to another company. Links to Google Maps, Apple Maps, WhatsApp and social networks take you to those services, whose own policies then apply.
Who receives your data
We do not sell personal data. We share it only as far as needed:
- within our team, so that the right person answers you;
- with the companies that provide our services: Cloudflare (website hosting and security), Google (our e-mail and records on Google Workspace), Meta (WhatsApp, if you write to us there), Mailchimp (the newsletter) and the providers that host our client records system;
- if you accept them, with the companies behind the analytics and advertising tools described above;
- with the people involved in what you ask about, and only with what they need: for example a yacht’s central agent or another broker acting for her, the shipyard for a new build, or a yacht’s captain or manager to check charter dates;
- with our professional advisers, and with public authorities or courts when the law requires it.
Transfers outside Türkiye
Some of these companies and people are outside Türkiye, for example in the European Union or the United States. We transfer personal data abroad only on a ground that Article 9 of Türkiye’s Law No. 6698 on the Protection of Personal Data allows. A one-off transfer, for example to a shipyard or a broker abroad about the yacht you ask about, is made only where it is necessary to perform a contract with you or to take steps you ask for before a contract.
How long we keep it
- Enquiries and our correspondence: while we are in touch about your request and anything that follows from it; then as long as Turkish commercial and tax law requires us to keep business records, or as long as we may need them to establish or defend a legal claim. When an enquiry needs nothing more and no law requires us to keep it, we delete it or make it anonymous.
- The newsletter: until you unsubscribe. We then keep a record of your unsubscribing, so that we respect it, and proof of your consent for as long as the law requires.
- Analytics: no longer than 14 months in Google Analytics.
- Your cookie choice: 12 months in your browser.
- The record of your cookie choice: as long as we may need to show the choice you made.
- Browser storage: on your device, until you clear it; the items kept for one visit go when you close the tab.
Your rights
You may ask us whether we hold personal data about you and what it is used for, ask us to correct or delete it, object to its use, and withdraw a consent at any time; withdrawing does not affect what we did before. We do not make decisions about you by automated means alone. The full list of your rights under Turkish law is in our KVKK information notice. If the EU or UK General Data Protection Regulation applies to you, you also have the rights it gives, such as restriction and data portability, and you may complain to your local data protection authority.
To use your rights, write to info@niyanayachts.com or to our address above. We answer within 30 days, free of charge unless the law allows a fee, and we may first ask you to show who you are.
Children
Our website is meant for adults, and we do not knowingly collect personal data from children.
Security
We use encrypted connections, give access to personal data only to the people who need it, and choose providers that protect it. As no website can be entirely secure, please do not send passport, bank or card details through the enquiry form or by e-mail.
Changes to this policy
We update this policy when the website or the law changes. The date of the current version is shown on this page.
